Status of the file as of March 13, 2017

At time of our appointment, 38 of 51 strata lots were only completed to the drywall stage. As of this update, all interior finishing of the 38 strata lots has been completed, with 3 occupancy permits issued and 35 to be issued shortly. The Receiver has also completed the following activities:

Completed and commissioned the Wastewater Treatment Plant;
Repaired the Water Treatment Plant;
- Completed repairs to the marina breakwater and docks;
Started the Strata Corporation with a functioning Strata Council;
Continued the rental program and marina operations;
Updated the Disclosure Statement required by Real Estate Development Marketing Act; and
Started marketing and sales of the strata lots.

The Receiver had filed its First Report to Court, which is available under the Receiver’s Report tab. The Report provides an update of the Receiver’s activities to date, status on the sales of the strata lots, and direction sought. At the March 13, 2017 hearing, the Court granted:

A Vesting Order approving the sale of strata lots 34 and 38;
A Vesting Order approving the transfer of Lot A to the Strata Corporation;
A Sealing Order approving the sealing of the Receiver’s Confidential Supplement to the First Report to Court;

Status of the file as of February 15, 2016

On February 15, 2016 PricewaterhouseCoopers Inc. was appointed Receiver by virtue of being appointed by the Nelson Supreme Court Registry in respect of only certain Lands and Premises and License of the Waterfront at Arrow Lakes and Marina.
