Claims Procedure

On September 18, 2019, the Ontario Superior Court of Justice (the “Court”) issued an order approving a claims procedure (the “Claims Procedure”) for the identification and determination of claims against the Student Federation of the University of Ottawa Inc. (“SFUO” or the “Company”).

Unless otherwise defined, all capitalized terms used herein shall have the meanings given to those terms in the Claims Procedure Order.

On September 19, 2019 a Claims Procedure Notice, Instruction Letter and a Proof of Claim form (the “Claim Document Package”) were sent to all Known Creditors of the SFUO pursuant to the Company’s books and records. The Claim Document Package is available at the bottom of this page.

The Claims Procedure is intended for any Person with a Claim against the Company, in connection with any indebtedness, liability or obligation of any kind, whether liquidated, unliquidated, contingent or otherwise, including any other claims that would be claims provable in bankruptcy had the SFUO made an assignment in bankruptcy as of the Receivership Date, being April 15, 2019.

All persons wishing to assert a Claim against the Company must file a Proof of Claim with the Receiver before 5:00 p.m. (Eastern Time) on October 11, 2019 (the “Claims Bar Date”).  Persons not filing a Proof of Claim in respect of their Claim by the Claims Bar Date, will not be entitled to participate in any distribution in respect of any such Claim.

PROOFS OF CLAIM MUST BE RECEIVED BY THE RECEIVER BY THE CLAIMS BAR DATE OR THE CLAIM WILL BE FOREVER BARRED AND EXTINGUISHED.

ANY DISTRIBUTION ON ACCOUNT OF PROVEN CLAIMS WILL BE ADDRESSED BY A SUBSEQUENT COURT ORDER.  SHOULD THE TOTAL VALUE OF ALL PROVEN CLAIMS EXCEED THE VALUE OF THE REALIZABLE ASSETS OF SFUO, CLAIMANTS MAY NOT RECEIVE THE FULL VALUE OF A PROVEN CLAIM IN ANY SUBSEQUENT DISTRIBUTION.

The Proofs of Claim will be evaluated by the Receiver, and where the Claim is disputed in whole or in part, the Receiver will issue a notice to the Claimant indicating the reasons for the revision or disallowance of the Claim (the “Notice of Revision or Disallowance”). The Receiver will issue any Notice of Revision or Disallowance by no later than 5:00p.m. (Eastern Time) on October 22, 2019.

Where a Claimant objects (the “Objection”) to an Notice of Revision or Disallowance, the Claimant must notify the Receiver of the objection by way of a notice (the “Dispute Notice”) in writing by registered mail, courier service, facsimile or email, setting out the grounds for the objection, by no later than 5:00 p.m. (Eastern Time) on November 1, 2019 (the “Objection Deadline”).

The Claims Procedure Order and the Notice of Revision and Disallowance provide for further details on how an Objection will be dealt with.

The table below sets out the deadlines for the Claims Procedure events:

5 p.m. (Eastern Time) November 1, 2019  Objection Deadline Deadline for Objecting Claimant to deliver written notice of an objection to a Notice of Revision or Disallowance to the Receiver.  
5 p.m. (Eastern Time) November 26, 2019  Notice of Objection Motion Deadline for Objecting Claimant to serve and file a notice of motion (the “Notice of Objection Motion”) with the Ontario Superior Court of Justice, 161 Elgin St., Ottawa, Ontario, K2P 2K1 returnable on December 6, 2019, for the purpose of scheduling a further date, for the determination of the Objection.
