Status of file as of March 21, 2023

On March 17, 2023, the Superior Court of Quebec issued a Fifth Amended and Restated Initial Order extending the stay period against Groupe Sélection Inc. et al. until June 22, 2023. We refer you to the Fifth Amended and Restated Initial Order dated March 17, 2023 for further information.

On the same day, the Superior Court of Quebec also issued an approval and vesting order authorizing the sales of certain assets related to projects Yimby and Waltz – District Union. We refer you to the Approval and Vesting Order dated March 17, 2023 for further information.

Status of file as of March 7, 2023

On March 7, 2023, the Superior Court of Quebec issued a Fourth Amended and Restated Initial Order authorizing supplemental interim facility. We refer you to the Fourth Amended and Restated Initial Order dated March 7, 2023 for further information.

On the same day, the Superior Court of Quebec also issued an approval and vesting order authorizing the sales of certain assets to Platinum CA Seniors Housing Holdings Inc. We refer you to the Approval and Vesting Order dated March 7, 2023 for further information.

Status of file as of February 22, 2023

On February 22, 2023, the Superior Court of Quebec issued a Third Amended and Restated Initial Order extending the stay period against Groupe Sélection Inc. et al. until March 22, 2023. We refer you to the Third Amended and Restated Initial Order dated February 22, 2023 for further information.

Status of file as of December 22, 2022

On December 21st, 2022, the Superior Court of Quebec issued a Second Amended and Restated Initial Order extending the stay period against Groupe Sélection Inc. and al. until February 22nd, 2023. We refer you to the Second Amended and Restated Initial Order dated December 21st, 2022 for further information.

On the same day, the Court authorized the filing of a redacted First Report of the Proposed Monitor on the Business and Financial Affairs of the Debtor Companies, which had been initially filed under seal. Said report in now available in the Monitor’s Report section of this website.

We also wish to advise you that on December 14, 2022, an application was filed with the Court by CAFO Inc. and that the hearing in respect thereof is scheduled for January 9, 2023. Status of file as of December 2, 2022 

On December 1st, 2022, the Superior Court of Quebec issued an Amended and Restated Initial Order extending the stay period against Groupe Sélection Inc. and al. until December 21st, 2022. We refer you to the Amended and Restated Initial Order dated December 1st, 2022 for further information.

Status of file as of November 28, 2022 

An application for leave to appeal of the Initial Order rendered on November 21, 2022 was filed on November 22, 2022 together with an application for a stay of the provisional execution of the Initial Order. On November 28, 2022, the Court of Appeal of Quebec issued a judgment dismissing the application for leave to appeal and, consequently, also dismissing the application for a stay of provisional execution.

Status of file as of November 21, 2022 

An initial order pursuant to the Companies’ Creditors Arrangement Act (“CCAA”) was rendered on November 21, 2022 by the Superior Court of Québec with respect to Groupe Sélection Inc. et al. (the “Initial Order”).

We refer you to Appendix A of the Initial Order available on the Monitor’s website for the list of the debtors included in this proceeding and to Appendix B for a list of the limited partnerships impleaded in the proceedings (collectively the “CCAA Parties”).

The Initial order provides for an initial stay of all proceedings against the CCAA Parties as well as their respective directors and officers until December 1, 2022 and appoints PricewaterhouseCoopers Inc. (Christian Bourque, CPA, CIRP, LIT) as Monitor of the business and financial affairs of the CCAA Parties. All proceedings against the CCAA Parties and their directors and officers are suspended as of November 14, 2022 pursuant to an interim order issued that day (the “Interim Order”).

Please, take note that the First Report of the Monitor will not be published on this site and that certain paragraphs of the Application for the issuance of the Initial Order are redacted, as they are subject to a confidentiality order issued on November 14, 2022, which is available on the Monitor’s website under the heading “Court Motions and Orders”.
