All terms not defined below have the meanings ascribed to them in the Claims and Unitholdings Identification Order.

By Order of the Ontario Superior Court of Justice (Commercial List), dated July 19, 2022, (the “Claims and Unitholdings Identification Order”), PricewaterhouseCoopers Inc., LIT in its capacity as Court-appointed receiver and manager of each of the Respondents (the “Receiver”) has been authorized to conduct:

  1. a procedure to, among other things, identify and quantify certain claims against the Respondents (the “Claims Identification Procedure”); and
  2. a procedure to confirm, among other things, the units held by each Unitholder and to identify and quantify certain claims against the Respondents (the “Unitholdings Identification Procedure”).

CLAIMS IDENTIFICATION PROCEDURE

In accordance with the Claims and Unitholdings Identification Order, on July 21, 2022 and July 26, 2022, the Receiver sent the Proof of Claim form, the Notice to Claimants and the Instruction Letter (the “Claims Package”) to each Known Claimant of the Respondents. The Claims Package may be found below on this page.
