On August 3, 2021, pursuant to an order (the “Receivership Order”) of the Ontario Superior Court of Justice (Commercial List), PricewaterhouseCoopers Inc., LIT (“PwC”) was appointed receiver and manager (the “Receiver”) without security, of all of the assets, undertakings and properties of Mohawk Trail Properties Inc., 2317159 Ontario Inc., and Mohawk Inn & Suites Management Inc. (collectively, the “Debtors”), pursuant to section 243(1) of the Bankruptcy and Insolvency Act (Canada), R.S.C. 1985, c. B-3, as amended and section 101 of the Courts of Justice Act, R.S.O. 1990, c. C.43, as amended. The Receivership Order was granted pursuant to an application made by Cortland Credit Lending Corporation, in its capacity as administrative and collateral agent in accordance with the mortgage loan facility agreement dated June 28, 2018, as amended (the “Applicant”).
