Scope of Services

Our Procurement practice offers comprehensive legal support for public and private procurement procedures, including:

  • advice on various procurement models established by law (i.e. an open tender, a competitive dialogue or a negotiated procurement procedure);
  • development of internal procurement documentation (i.e. guidelines and policies) in accordance with the legislation and best business practices; 
  • development of standard tender document forms with a focus on specific needs and circumstances of the company/public agency;
  • tender documentation review or drafting including purchasing agreements for the contemplated procurements;
  • assistance during procurement process: reviewing submitted tender offers, checking vendors’ business reputation, assisting with evaluation of submitted offers based on the established assessment criteria;
  • participation in negotiations with potential vendors;
  • representation of clients’ interests in case of disputes with state agencies or vendors. 
  • advice on specifics of public procurements and legal aspects related to the participation therein;
  • assistance with preparation and submission of proper set of documents according to the requirements of tender documentation;
  • ongoing legal support during entire procurement procedure (clarifying tender documents specifications, verifying the status of the procedure, etc.);
  • participation in negotiations with buyers;
  • represent vendors’ interests before state agencies (i.e. the Antimonopoly Committee of Ukraine, courts) and challenging results of procurement process, if needed.
