Local subsidiary of multinational group, assisted by PwC Legal Ukraine, prevails in dispute with Tax Office

PwC Legal Ukraine successfully represented Ukrainian subsidiary of multinational agrochemicals and seeds producer, in its claim against Ukraine’s central tax authority for a refund of an overpaid corporate profits tax.
The overpayment came about as the result of the seasonal nature of the Client’s business. The case took on additional complexity because the Client kept using the overpaid taxes against its existing tax liabilities for more than 2 years.
Overall, the company overpaid USD 6 million in corporate profit taxes.
The PwC Legal team developed the winning strategy and built a solid case supported with extensive documentary evidence of accumulated tax overpayments and good faith actions by the taxpayer.
The case made it all the way to the Ukrainian Supreme Court, which sided with the taxpayer, granting the Client’s claim in full.
