Review of the legislative changes in the international trade

To the attention of the exporters and importers of goods, which are subject to veterinary control

Starting on 13 April 2021, the State Service of Ukraine on Food Safety and Consumer Protection will issue and admit new bilateral forms of veterinary certificates (available through the link) while exporting from Ukraine to Azerbaijan, Belarus, Kazakhstan, Moldova, Tajikistan, Turkmenistan and while importing to Ukraine from above countries. At present time the certificate forms for international trade are being agreed with Armenia, Uzbekistan and Kyrgyzstan.

To the attention of the exporters and importers in terms of the determination of the origin of goods

In order to harmonize with the Customs Code of the European Union in terms of determining non-preferential origin for import / export of goods to / from Ukraine, the Section II "Country of origin of goods" of the Customs Code of Ukraine is expected to be changed in a short time. The Draft Bill has been already approved by the Cabinet of Ministers of Ukraine and submitted to the Verkhovna Rada.

The Draft Bill establishes:

  • particularities for determining the origin of accessories, spare parts and tools, neutral elements and packaging
  • a list of fully-assembled goods in certain country or territory
  • criteria for sufficient processing of goods which are produced by using the materials of foreign origin
  • criteria of insufficient processing and technological operations
  • list of simple operations
  • equal legal force for both electronic and paper forms of the document for confirming the origin of goods
  • the procedure for customs checks of the certificates of goods origin (including electronic certificates of origin) after completion of the customs clearance
  • application (renewal) of the most favoured national tariff, provided that the customs authority receives a duly executed relevant document of origin of goods no later than 1095 days from the date of customs clearance.
