Strategically navigating Malta’s new labour migration policy measures

In July 2025, several new measures were introduced under Malta’s updated labour migration policy.

These measures may significantly impact on how you, as an employer, plan for and engage with third country nationals (TCNs).

The stakes are high; a wrong move may lead to permit refusals, substantial hiring delays, and even penalties – any of which could substantially disrupt your operations and potentially hurt your business.

Some of these measures have already come into effect, while others will be rolled out progressively over time.

Asking the right questions is key and here is some guidance to help you start thinking through the implications:

Is your workforce substantially made up of TCNs?

Are there plans to expand your workforce or hire more non-EU/EEA employees in the coming months?

Do you experience a degree of resignations, terminations or staff turnover?

How quickly do your business or staffing needs change? Do you try to anticipate future needs?

Are all payroll, tax filings, and compliance obligations up to date?

Are you compliant with the Persons with Disability (Employment) Act?

Is your cash flow healthy enough to absorb increased salary thresholds and increased administrative or governmental fees?

Is the prospective employee already in Malta? If so, what type of visa (if any) are they on? If not, are you aware of all available options?

Is the prospective employee proficient in English? Are they open to attending courses/certifications before and after relocating to Malta? Are they the best fit for the job, and how well will you be able to prove it?

Through what means are employees currently remunerated?
