On July 14, 2021, Minister of Ecology, Geology and Natural Resources of the Republic of Kazakhstan, approved the Rules for the development of a program for industrial environmental control of objects of I and II categories (hereinafter the "Rules"). These Rules were introduced on the basis of the provisions of the new Environmental Code (hereinafter – the “Code”) providing for an obligation for operators of facilities of I and II categories to implement industrial environmental control.
According to the provisions of the Code, enterprises and industries carrying out certain types of activities (energy, subsoil use and chemical production), listed in the Code and depending on their negative impact on the environment, are recognized as objects of I or II category. At the same time, according to the Code, an individual or legal entity that owns or otherwise legally uses the above facilities is defined as the operator of the facility and is obliged to carry out industrial environmental control in accordance with the Rules.
