Kazakhstan approved the Rules for the preparation of a program of industrial environmental control

Briefly 

On July 14, 2021, Minister of Ecology, Geology and Natural Resources of the Republic of Kazakhstan, approved the Rules for the development of a program for industrial environmental control of objects of I and II categories (hereinafter the "Rules"). These Rules were introduced on the basis of the provisions of the new Environmental Code (hereinafter – the “Code”) providing for an obligation for operators of facilities of I and II categories to implement industrial environmental control. 

In details 

According to the provisions of the Code, enterprises and industries carrying out certain types of activities (energy, subsoil use and chemical production), listed in the Code and depending on their negative impact on the environment, are recognized as objects of I or II category. At the same time, according to the Code, an individual or legal entity that owns or otherwise legally uses the above facilities is defined as the operator of the facility and is obliged to carry out industrial environmental control in accordance with the Rules.

The Rules provide for the following:

  • The program for industrial environmental control must be approved by the head of the enterprise which recognized as object of I and II category; 
  • The elements of industrial environmental control are industrial monitoring, as well as programs to improve environmental performance; 
  • Within the framework of industrial monitoring, operational monitoring, monitoring of emissions into the environment and monitoring of impact are carried out; 
  • The operator of the object of I and II category is obliged to maintain internal records, prepares and submits periodic reports on the results of industrial environmental control. Such periodical reports must be submitted in electronic form to the information system of the authorized body in the field of environmental protection; 
  • The introduction of the Rules provides that the previous Order of the Minister of Energy of the Republic of Kazakhstan dated November 20, 2014 No. 132 "On approval of the Rules for organizing and conducting industrial environmental control during oil operations in the Kazakhstan sector of the Caspian Sea" has ceased to be valid.
