The Government of Kazakhstan has developed a draft resolution on introduction of amendments to the resolution of the Government of Kazakhstan dated 24 November 2023 No.1041 “on determining the list of persons for whom the permission of local executive authorities is not required to attract foreign labourfor carrying out labouractivities” (the “draft Resolution”).

In details

According to the current laws of Kazakhstan, the head and deputies of the head of legal entities, registered in Kazakhstan, with 100% share of foreign participation are exempt from the need to obtain a work permit.

However, the draft Resolution provides for a change in this rule. In particular, the draft Resolution stipulates that the work permit is not required for persons, who hold position of a head or deputy of the head of a Kazakhstan legal entity (not more than 1 unit per position) with 100% share of foreign participation, provided that the charter capital of such legal entity shall not be less than USD 300,000 in equivalent.
