Penalties for environmental violations are increased

Briefly

On 29 June 2022, Mazhilis of Kazakhstan approved the draft law s, increasing liability of legal entities for environmental violations. In particular, the Kazakhstan Code On Administrative Violations dated 30 January 2001 w ill be supplemented w ith new articles, according to w hich the amount of penalties for environmental violations w ould be significantly increased. 

In details

It is planned to tighten the responsibility in the follow ing areas:

  • for non-compliance w ith the environmental protection action plan, w hich w ould entail a fine for small or medium-sized businesses in the amount from KZT 95,400 to KZT 159,000, for large business in the amount from KZT 222,600 to KZT 318,000; 
  • for non-compliance w ith the program of industrial environmental control and (or) failure to submit reports on industrial environmental control, w hich w ould entail a fine for small or medium-sized businesses in the amount of KZT 318,000, for large businesses in the amount of KZT 1,590,000; 
  • for exceeding the standards of emissions into the environment, established in the environmental permit, w ould entail a fine for small or medium-sized businesses in the amount from KZT 63,600 to KZT 159,000, for large businesses in the amount from KZT 2,703,000 to KZT 3,180,000; 
  • for exceeding the established volume of greenhouse gas emission quotas, w hich w ould entail a fine for legal entities in the amount of KZT 31,700 for each exceeded ton of carbon dioxide equivalent from the established volume of greenhouse gas emission quota.
