The AI literacy obligation set forth by the EU AI Act applies from February 2025, and non-compliance is sanctioned from August 2025. It applies to all EU private and public entities regardless of size. Organisations that do not comply with the EU AI Act may face fines of up to EUR 15 million or 3% of their worldwide turnover.

What is the purpose of the EU AI Act and who is in scope

The EU AI Act is a comprehensive regulation that governs the development and use of artificial intelligence (AI) within the European Union. It aims to ensure that AI systems are safe, transparent, and respect fundamental rights. All the companies or public entities operating in the EU regardless of headcount or annual turnover, which use paid licenses of AI tools in their daily operations (e.g. M365 Copilot license) are obliged to provide some form of AI literacy training to their employees. This also applies for companies which are not developing AI tools, only using them.

AI literacy – in effect since 2 February 2025

The EU AI Act emphasises AI literacy as a foundational principle. Organisations are required not only to understand but also to actively manage the risks associated with AI technologies, ensuring these systems are used responsibly and ethically to safeguard your organisation and its stakeholders. AI literacy involves understanding the opportunities and risks of AI, applying technical knowledge appropriately, and considering the broader societal impacts of AI.

Are non-EU companies also affected

The EU AI act also applies to companies, which are operating outside the EU and developing, providing, importing or distributing AI systems as long as it is marketed in the EU or its use affects individuals located in the EU.
