Angola – Teleworking regime

In brief

The published Presidential Decree no. 52/22, of 17 February, regulates the performance of teleworking, by establishing that this regime can be adopted on the following circumstances:

(i) By agreement between the Employer and the Employer, upon proposal by either party, or

(ii) In the cases expressly provided for in the diploma, at the request of the Employee without the possibility of refusal by the Employer. Such cases include:

  • Pregnant women with justified health condition;
  • Individuals responsible for caring for a child under 5 years of age or a dependant person with a certified disability or incapacity equal to or greater than 60%;
  • Individuals with a health condition incompatible with presential work, duly attested;
  • When a State of Constitutional Necessity is declared.

The diploma also defines the applicable rules regarding the form of the employment contract (which must be in writing), working hours (which must be the normal working hours set forth in the General Labor Law), as well as the obligation of reimbursement by the Employer of expenses incurred by the Employee with the acquisition or use of any means necessary for teleworking.

The aforementioned diploma will enter into force 30 days after the date of its publication.
