Overview

Washington Governor Jay Inslee (D) on February 11 signed legislation (S.B. 6492) to overhaul the three-tier Workforce Education business and occupation (B&O) tax surcharges enacted in 2019 (see prior Insight).

The takeaway

Recent changes to Washington’s workforce education investment laws will impact most businesses reporting under the ‘service and other activities’ classification. Primarily, the new law clarifies some, but not all, of the ambiguities introduced with the 2019 legislation.  The clarifications vary between being beneficial or unfavorable depending on the taxpayer’s business.  Taxpayers should expect guidance from the Department of Revenue on some of these issues in the coming months.
