Issues for employers following Supreme Court ACA decision

Retail & Consumer Products Quickbrief

A divided Supreme Court has ruled that the requirement under the Affordable Care Act (ACA) that all Americans have health insurance is a constitutional exercise of Congress's power to tax. The Court substantially upheld the law, while giving states the option not to comply with the ACA's Medicaid expansion. The opinion does not end the debate about healthcare, and issues of cost and coverage will continue to be a focus of federal and state policymakers, the healthcare industry, and employers. While, in some sense, the Supreme Court decision affirming a law that has been in effect for two years should not be news for employers, it provides an impetus to refocus on a strategic, long-term view of their role in providing quality, affordable healthcare for their employees.
