Under the Nuclear Waste Policy Act of 1982, the DOE was given the task of constructing and operating a permanent underground nuclear waste repository located at Yucca Mountain in Nevada. To fund the site, entities that produce nuclear energy are required to pay to the DOE one dollar per megawatt-hour of net nuclear generation for the cost of spent nuclear fuel disposal (the “disposal fund charge”).
