PwC Ukraine invites you to a Business Breakfast dedicated to the practical aspects of Ukrainian antimonopoly regulation.

Ukrainian legislation on competition and its practical application are continually developing. In particular, recent developments concern the competencies of the Antimonopoly Committee of Ukraine (the “AMCU”), the level of fines they impose, and enhanced risks related to certain types of marketing and distribution activities.

The AMCU’s current activity seems particularly focused on investigating retail chains, as well as addressing advertisements for food and pharmaceutical products. Such developments make it advisable to review and consider market practices in order to mitigate the possible competition violations and to avoid significant penalties.

Given the above, we will focus our discussion on the antimonopoly regulation and the court practice in regard to the pharma and retail businesses.

Agenda:

  • Antitrust risks associated with similar conduct on the market (simultaneous increases in price and maintaining prices at the same level).
  • «Bottlenecks» (gaps and ambiguities) in the regulation of distribution agreements: chain manufacturers – exclusive distributors (agents) – regional distributors – retail.
  • Summarizing the practice of the AMCU and the courts related to unfair advertising.
  • How the AMCU exercises its authority.
