The latest India Budget was pronounced in March 2012, a milestone event that spells out compelling reasons for the Private Equity world to reconsider the conventional manner of making and exiting investments in India.  The proposed General Anti Avoidance Rule and taxation provisions for offshore transfer of assets deriving value from India could significantly change the landscape of cross border transactions for India.

Besides the Budget 2012, tax authorities in India are more aware and aggressive than ever.  The retrospective amendments introduced into the law time and again challenge the basis of planning investments in India.   

In such an uncertain environment, it is important to be in the know in relation to ground realities of an otherwise lucrative investment destination.
We have experts from India to discuss critical aspects that the fund managers and investors need to know on what could impact IRR and how to protect their interests in the investment chain.  Further, together with experts from Singapore, we will also discuss how Singapore, with its inherent advantages, could be offered as a potential solution to tackle with some of the Indian tax risks arising from the proposed changes as mentioned above, taking into account some interesting developments in the Singapore Finance budget 2012.

About the speaker

Anish Sanghvi is an Associate Director with the Tax & Regulatory practice of PwC, India. Anish has over 13 years of work experience with international consulting firms.  He specialises in M&A tax and inbound advisory with a focus on real estate, infrastructure and private equity sectors.  He has significant experience in advising clients in areas of transaction advisory, fund structuring, inbound investment advisory, corporate tax and international tax. Anish has been actively involved in advising private equity and venture capital fund clients in structuring their pooling vehicles (including undertaking jurisdiction analysis, carry structuring, documentation review, etc.)."

Teo Wee Hwee is a Tax Partner with PwC Singapore and provides tax consulting services to clients in a wide array of industries, with a focus on real estate and wealth management.  His current portfolio consists mainly of real estate companies, real estate funds, REITs, business trusts, infrastructure funds, private equity funds and sovereign wealth funds.   Wee Hwee liaises and meets up frequently with the Monetary Authority of Singapore to resolve tax issues for clients.  He has also been working closely with the Singapore Exchange to promote REIT and Business Trust listings in Singapore.  In addition, Wee Hwee has extensive experience in advising foreign and local multinationals on their cross-border transactions, and is familiar with permanent establishment issues, profit repatriation methods, tax efficient exit strategies and withholding tax planning.
