Pharmaceutical Industry Sector

Established 5 years ago, our team (currently comprising 6 members) provides tax advisory services to an overwhelming majority of international pharmaceutical companies operating on the Polish and Eastern European markets.

Our sector expertise combined with extensive knowledge of tax and sector-specific regulations (pricing restrictions, licensing requirements, GMP and GCP standards, etc.) result in the scope of services offered by the team going largely beyond the standard tax advisory practice and including certain industry-specific legal and business issues:


tax effective financing (discounts, premiums, agency structures etc.);


structuring of clinical investigation activities (including their tax implications);


optimisation of costs relating to transfers of diagnostic equipment to business partners

Many years of experience, technical knowledge gained through co-operation with clients and current involvement in tax and legal issues common to the entire pharmaceutical sector make it possible for our team members to participate in the projects performed on behalf of industry organisations associating importers, producers and distributors of pharmaceuticals, e.g.


negotiating prices of subsidised medication with the Ministry of Health;


implications of regulatory changes affecting state-regulated margins, etc.

As part of its activities, the Pharmaceutical Team developed a number of varied solutions and products which have been welcomed by the clients and, following their adaptation to the specific needs of particular PwC clients and implementation, set the standards in the functioning of the pharmaceutical sector in Poland. These include, among others:


designing of optimum structure for pharmaceuticals distribution in Poland (off-shore sales, domestic sales, use of bonded warehouses, consignment structures, agencies etc.);


Optimisation of marketing costs of pharmaceutical companies operating in Poland;


planning and implementation of business- and tax-effective transformations of pharmaceutical companies: mergers, privatisations, restructuring etc.
