This is our third report on the subject of how the EU single market is developing in the UCITS fund area. Since our first report in 2001, significant progress has been made. It is quite clear that the European Court is prepared to strike down laws that frustrate the development of the single market where it can be shown that the law conflicts with a fundamental freedom enshrined in the EU Treaty.
