The Ministry of Home Affairs (“MHA”) clarified in October 2010 that Foreign Nationals (“FNs”) must draw a salary of at least USD 25,000 per annum for the grant of an Employment Visa (“EV”). The Ministry of Home Affairs later clarified in December 2010 that the said threshold limit of salary would include salary and all other allowances paid in cash. Perquisites received in kind such as housing, telephone, transport, etc. would not be included. The MHA has recently come out with clarifications widening the scope of the term “salary” and also prescribed the ceiling on salary for FNs coming into India for Honorary assignments.
