Indian Government issues tax residency certificate guidelines for tax residents and non-residents

In the Finance Act 2012, the Indian Government made it mandatory for non-residents to produce a tax residency certificate (TRC) from the home country revenue authority when seeking to avail themselves of tax treaty benefits.  The requirement is with respect to income arising from the Indian fiscal year ending on March 31, 2013 and subsequent years.

The format of the TRC was to be prescribed by the Indian Revenue. The Indian Government has now issued guidelines on the format of a TRC for non-residents.  In addition, the Indian Government has also issued guidelines for a TRC if required by any Indian tax resident.
