Declaration of customs value
In accordance with article 262 of the new Customs Code, the customs value of goods moved across the customs border of Ukraine is subject to a declaration by filing the declaration of customs value (DCV) to the customs office.
DCV must be filed in addition to the import customs declaration where goods moved across the customs border are subject to taxes and/or the goods customs value exceeds EURO 5,000, provided the specific consignment is not a partial delivery under one contract or multiple deliveries of the same goods by one consignor to one consignee under different contracts.
To evidence the customs value the declarant must submit to the customs office the following documents:
- Contract;
- Invoice, banking payment documents (in case of advance payment);
- Proforma invoice for free of charge deliveries and/or accounting documents confirming goods value;
- Contract for transportation of goods, transport and insurance documents;
- Invoice for transport services or calculation of transport charges;
- Packing lists;
- Export/import licenses; and
- Certificates of origin, quality, safety, etc.
The customs office may require submission of other documents that can be used for determining the customs value.
The customs office may verify the customs value by auditing the declarant’s accounting records for compliance with a DCV and supporting documents.
The customs office is authorized to determine customs value where:
- The declarant is not able to provide documentary support of customs value; and
- There are sufficient reasons to doubt data submitted by declarant.
The customs office can adjust customs value at the moment of customs clearance and after release of goods for free circulation. The declarant is allowed to appeal valuation of goods by customs office, however, is not relieved from the obligation to pay taxes based on such valuation.
DCV will apply with introduction of the new Customs Code, which is scheduled for 1 January 2004.
