With the entry into force of the Fifth Protocol to the Canada-US Income Tax Convention on December 15, 2008, many of its provisions, including those relating to employees, took effect for the 2009 taxation year. As a result, cross-border employees face new tax rules regarding the reporting of their income and deductions in both Canada and the US. While the Protocol provisions provide some relief for taxpayers, they also may increase the compliance and reporting requirements for employers.
