On August 28, 2009, the Judicial Trustee prepared its Ninth Report to the Court to provide the Court with sufficient information to enable it to provide directions to the Judicial Trustee in respect of the following issues:

On December 9th, 2005, the Judicial Trustee applied to Court to report circumstances which enabled it to repay customer claims against both Trusts ("Ontario" and "B.C. and other") in full, and to seek permission to pay the remaining balance of those claims in full. With the Court's approval, the Judicial Trustee paid these amounts out in December 2005.

No other funds will be available for distribution to unsecured creditors of the Company. Please note that passengers with additional expense claims, September 11 disruption claims, etc. are unsecured creditors and these claims will not be paid.
A considerable number of cheques to these employees have been returned or otherwise remain uncashed. If you are an employee and did not receive your dividend payment, please contact the Canada 3000 Holidays Claim Center at 1 888 689 8233 or email anna.melo@ca.pwc.com.

For those passengers with an unsecured claim in the bankruptcy estate (for example, September 11th disruption, passengers with additional expense claims, employees etc.) please be advised that all information available to the Trustee at this time indicates that there will be no recovery to the unsecured creditors.

Judicial Trustee
The following information is for individuals who had a claim with Holiday Travel Consultants Ltd. dba as Canada 3000 Tickets ("Tickets").
For claimants who booked travel with an Ontario based Tickets office:
On September 21, 2002 the Judicial Trustee distributed a dividend to Ontario claimants which represented 70% of the individual’s claim. No other funds are available for distribution.
For claimants who lived in B.C. and booked with a B.C. based Tickets office:
The Courts confirmed that the funds held in Tickets' B.C. trust bank account were, in fact, not held in trust and therefore cannot be used for the benefit of Tickets' B.C. claimants. No distribution was made to B.C based claimants.
For claimants in all remaining provinces and territories:
Tickets did not have trust funds set aside for passengers in these provinces and therefore there were no funds available to these claimants. Each of these claimants will be classified as an unsecured creditor in Tickets' bankruptcy estate. The Bankruptcy Trustee does not anticipate that there will be any funds available for distribution to Tickets' unsecured creditors.

Employee Preferred Claims:
In September 2003, the Trustee made the first distribution of funds, equal to 50% of each preferred claim. In February 2004, the Trustee distributed the remaining 50% of each preferred claim.
The Trustee does not anticipate that there will be any funds available for distribution to Tickets' unsecured creditors.
