    On January 5, 2009, the Court of Queen's Bench of Alberta approved a Notice of Motion for the sale of a substantial portion of the assets of Birch Mountain to 1439442 Alberta Ltd. A copy of the Notice of Motion is attached below.

    In Receivership as of November 5, 2008:

    On November 5, 2008 PricewaterhouseCoopers Inc. was appointed as Receiver of Birch Mountain Resources Ltd. by the Court of Queen's Bench of Alberta pursuant to an application made by Tricap Partners Ltd.

    In accordance with the provisions of the BIA, the Receiver's notice and statement will be issued shortly.
